1. Introduction
These Terms of Service (“Terms”) govern access to and use of the Revelry platform, including the mobile application, web application, organizer dashboard, APIs, and all related services (the “Services”).
By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree, you may not use the Services.
2. Definitions
Revelry: Revelry, a Dutch general partnership.
User: Any individual or entity using the Services.
Organizer: A User who creates, manages, or promotes an Event.
Attendee: A User who purchases or registers for a Ticket.
Event: Any activity, performance, gathering, or experience listed on Revelry.
Ticket: A digital right of admission issued via Revelry.
Content: Any information uploaded by Users.
Personal Data: Information relating to an identified or identifiable natural person.
3. Eligibility
You must be at least 16 years old to use the Services.
If you are under 18, you must have parental or guardian consent.
By using the Services, you confirm that you have legal capacity to enter into binding agreements.
4. Account Registration
Users must provide accurate and complete information.
You are responsible for:
- •Maintaining the confidentiality of login credentials
- •All activity under your account
- •Promptly notifying Revelry of unauthorized access
Revelry may suspend or terminate accounts that violate these Terms.
5. Role of Revelry (Limited Intermediary)
Revelry provides a technology platform that enables Organizers to manage Events and sell Tickets.
Revelry:
- •Does not organize, host, promote, or supervise Events
- •Does not control Event execution, safety, legality, or quality
- •Does not verify Organizer permits, insurance, or compliance
- •Is not a party to the contract between Organizer and Attendee
The contract for Event attendance exists solely between the Organizer and the Attendee.
Any disputes relating to an Event must be resolved directly between Organizer and Attendee.
Revelry acts solely as a neutral technical intermediary.
6. Organizer Responsibilities
Organizers represent and warrant that:
- •They have full authority to host and sell tickets for the Event
- •All Event Content is accurate and lawful
- •They comply with all applicable laws and regulations
- •Necessary permits, licenses, and insurance are obtained
- •They have a lawful basis to process Attendee Personal Data
Organizers are solely responsible for:
- •Event execution and safety
- •Ticket pricing and availability
- •Event rules and entry policies
- •Refund and cancellation policies
- •Tax compliance
- •Handling complaints
6.1 Refunds & Cancellations
Event tickets are exempt from the 14-day withdrawal right under EU consumer law.
If an Organizer cancels an Event, Attendees are entitled to a refund of the ticket price unless they voluntarily accept an alternative.
Refunds:
- •Are governed by the Organizer’s policy
- •Exclude non-refundable payment processing fees
- •Remain financially borne by the Organizer
Revelry does not fund or guarantee refunds.
7. Payments, Fees & Risk Control
All payments are processed via Stripe.
Revelry:
- •Does not store full credit card details
- •Is not responsible for payment processor decisions
- •May deduct fees, chargebacks, refunds, and penalties from Organizer payouts
7.1 Fraud & Withholding
Revelry may:
- •Delay or withhold payouts for fraud review
- •Suspend Events suspected of unlawful activity
- •Reverse payouts in case of disputes or chargebacks
- •Recover losses caused by Organizer misconduct
Organizers authorize Revelry to deduct such amounts from current or future payouts.
7.2 Payout Timing
Payouts are subject to:
- •Stripe settlement schedules
- •Risk assessments
- •Compliance checks
Revelry does not guarantee immediate payouts.
8. Attendee Responsibilities
Attendees agree that:
- •Ticket purchases are binding
- •Entry may require presentation of a valid QR code
- •Lost, shared, or duplicated tickets may be denied entry
- •Venue and Organizer rules must be followed
Revelry is not responsible for:
- •Event cancellations
- •Event changes
- •Injuries or damages at Events
- •Organizer misconduct
9. Data Protection (GDPR)
9.1 Roles
Organizers act as Data Controllers for Attendee data collected for their Events.
Revelry acts as Data Processor for Event-related data.
Revelry acts as Data Controller for its own operational data.
9.2 Processing
Revelry processes Personal Data only:
- •To provide the Services
- •On documented Organizer instructions
- •In compliance with GDPR
Revelry implements appropriate technical and organizational security measures.
9.3 Subprocessors
Revelry may use subprocessors, including:
- •Stripe (payments)
- •Supabase (database hosting)
- •Hetzner (infrastructure hosting)
- •Vercel (hosting)
- •Resend (email delivery)
Appropriate contractual safeguards are in place.
10. Intellectual Property
All platform software and branding remain the property of Revelry.
Organizers grant Revelry a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute Event Content solely for the purposes of:
- •Operating the Services
- •Promoting Events listed on the platform
- •Marketing the Revelry platform
Revelry may also use anonymized and aggregated statistics relating to Events (such as ticket sales volumes, attendance figures, and platform usage metrics) for marketing, analytics, and promotional purposes.
Users may not reverse engineer, scrape, or misuse platform technology.
11. Prohibited Conduct
Users may not:
- •Use the Services unlawfully
- •Commit fraud
- •Circumvent platform fees
- •Manipulate QR codes
- •Disrupt platform security
Revelry may suspend accounts without notice for violations.
12. Force Majeure
Revelry shall not be liable for failure or delay caused by events beyond its reasonable control, including:
- •Natural disasters
- •Government restrictions
- •War or civil unrest
- •Internet or telecommunications failures
- •Payment processor outages
- •Hosting provider downtime
- •Cyberattacks
Obligations are suspended during such events.
13. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
Revelry makes no guarantees regarding:
- •Platform availability
- •Event quality
- •Organizer compliance
Temporary downtime or technical failures do not create liability.
14. Limitation of Liability
To the maximum extent permitted by law:
Revelry shall not be liable for:
- •Indirect or consequential damages
- •Loss of profits
- •Loss of data
- •Event-related injuries
Revelry’s total aggregate liability shall not exceed the greater of:
- •(i) The total fees paid to Revelry in the preceding 12 months; or
- •(ii) €1,000
Nothing excludes liability for gross negligence or willful misconduct.
15. Indemnification
Organizers agree to indemnify and hold Revelry and its partners harmless from any claims, damages, or expenses arising from:
- •Their Events
- •Their Content
- •Violations of law
- •Data protection violations
- •Personal injury claims
- •Consumer claims
16. Termination
Revelry may suspend or terminate access at its discretion.
Upon termination:
- •Outstanding fees remain payable
- •Liability and indemnification provisions survive
17. Governing Law & Jurisdiction
These Terms are governed by Dutch law.
Any dispute shall be submitted exclusively to the competent courts of the Netherlands.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between Users and Revelry.
If any provision is held invalid, the remainder remains enforceable.
